Delaware Public Records

Some of the exemptions to this open access include: Personnel, medical, pupil files; trade secrets & commercial or financial information; open investigation files; records exempt by statute or common law; charitable contributions; labor negotiations; pending litigation; concealed weapon permits; public library users; Department of Corrections records; and records whose release could jeopardize the public.

  • Court System - The Delaware court system has four levels. First is the Justice of the Peace Courts, which handle civil cases under $15K, misdemeanors & non-felony motor vehicle cases. At the next level are the Court of Common Pleas and Family Courts. The former handles civil cases up to $50K, non-drug/traffic misdemeanors & felony preliminary hearings. The latter handles family & juvenile matters. Third are the Superior & Chancery Courts. The Superior Court is the general jurisdiction court that handles civil cases of any size, felonies, drug offenses & appeals from lower courts. The Court of Chancery handles equity matters involving corporations, trusts, estates, commercial & contract cases. At the top is the Supreme Court, responsible for appeals from the Chancery, Superior & Family courts.  Delaware Court Records
  • Criminal Records - Some misdemeanors and non-felony motor vehicle cases are handled by the Justice of the Peace Courts. The Court of Common Pleas handles non-drug & non-traffic misdemeanors and felony preliminary hearings. The Family Court oversees juvenile matters.   • Vital Records - Birth, death, and marriage certificates are provided by: Office of Vital Statistics, Jesse S. Cooper Bldg, 417 Federal Street, Dover, DE 19901, (302) 744-4549, Fax: (302) 736-1862. The Capital is Dover and the largest city is Wilmington.  The Official Web Site is located at http://www.delaware.gov/.  Delaware is the 45th most populous state in the United States.  The 2014 population estimate is 935,614 and the 2010 census population was 897,936.  The land area is 1,948.54 square miles and there are 460.8 persons per square mile.

71.1% of the population is White, 22.1% is Black or African American, 8.7% is Hispanic or Latino, 3.6% is Asian, 0.7% is American Indian or Alaska Native, 0.1% is Hawaiian or Pacific Islander, and 2.4% are two or more races. 87.7% are a high school graduate or higher, and 28.9% have a Bachelor degree or higher.

The median home value is $235,800. There are on average 2.63 persons per household, the per capita income is $29,819, the median household income is $59,878, and 11.7% of the persons in Delaware are considered below poverty level.
